These Terms of Service ("Terms") are an agreement between you and Enjoy Digital LLC, a Wyoming limited liability company doing business as GOLDGCP ("GOLDGCP", "we", "us"). They apply when you use goldgcp.com, our cost estimators, the AI assistant, the client portal, our app and any other service we offer (the "Services"). By using the Services, or by checking a box or clicking a button that refers to these Terms, you agree to them. If you do not agree, do not use the Services.
Contractors who subscribe to GCP Pro also agree to the GCP Pro Terms. Text messages are covered by our SMS Terms, and our Privacy Policy explains how we handle personal information.
What GOLDGCP is, and is not
- GOLDGCP is an online platform that helps homeowners find independent home-improvement contractors and helps contractors find work.
- GOLDGCP is not a contractor. We do not perform, supervise, inspect or guarantee any work. We are not a party to any agreement between you and a contractor, and contractors are not our employees, agents or partners.
- GOLDGCP is free for homeowners. Contractors pay GOLDGCP a monthly subscription to receive quote requests and use our tools, and a success fee when a homeowner we introduced signs a contract with them. You pay only the price in your contract with the contractor; GOLDGCP charges you nothing. Those payments do not change which contractor is right for your job, and you are never required to hire anyone.
- Any contract, price, schedule, warranty, permit and payment for the work is between you and the contractor you choose.
Quote requests and matching
- When you request quotes, you authorize us to share your request with up to 3 contractors we match to your service and ZIP code, so they can contact you about that request. The Privacy Policy lists exactly what we share.
- We cannot promise that a contractor is available in every area, that any contractor will respond, or that you will receive a certain number of quotes.
- Please give accurate information. We may decline or remove requests that are false, abusive or outside the services we support.
How we check contractors
Before a contractor can receive requests, we review the information described on our vetting page, such as state license status and proof of insurance. These checks reflect what we could verify at the time of the review. They are not a guarantee of a contractor's work, honesty, licensing status today or insurance coverage today. Always confirm a contractor's license with your state licensing board, ask for a current certificate of insurance, and get a written contract before work starts.
Prices, cost estimators and estimates
Prices on the Services, including cost estimator results, ZIP-code price ranges and cost guides, are estimates based on aggregated data and stated assumptions. They are not quotes, offers or guarantees. Your actual price comes from the contractor and depends on the job, site conditions, materials and permits.
Estimates and invoices from contractors. A contractor may send you an estimate or invoice through GOLDGCP. It comes from that contractor, who is responsible for its content. When you accept an estimate online, you type your name and sign electronically, and we keep a record of it (name, signature, time, IP address and browser). Accepting an estimate approves it and asks the contractor to prepare a written contract; it is not the contract. Read the contract before you sign it or pay anything. You pay the contractor directly, and GOLDGCP does not receive or hold those payments.
The AI assistant
- The assistant is an automated AI program, not a person. It answers general questions about prices, permits and finding a pro.
- AI answers can be incomplete or wrong. They are not professional, legal, engineering, financial or safety advice. Check important information with a licensed professional or your local building department.
- Messages you send to the assistant are processed by our AI service provider as described in the Privacy Policy. Do not share passwords, payment card numbers or health information in the chat.
Accounts and the client portal
You are responsible for keeping your login and project codes private and for activity under your account. Tell us right away at info@goldgcp.com if you think someone else has used them.
Payments
At this time, homeowners pay contractors directly; GOLDGCP does not collect or process payments for work. If we later offer milestone payments through the Services, they will be governed by our Payment Terms, and GOLDGCP will never hold your funds itself.
Reviews and content you share
- If you post reviews, photos or other content, it must be truthful, based on your own experience and lawful. You keep ownership, and you give GOLDGCP a non-exclusive, worldwide, royalty-free license to host, display and share it in connection with the Services.
- We do not accept paid or fake reviews, and we do not remove reviews because they are negative. We may remove content that is unlawful, abusive, off-topic, contains personal information or breaks these Terms.
Acceptable use
You agree not to:
- break the law or anyone's rights;
- scrape, copy or resell our content, prices or data, or use automated tools to collect them;
- interfere with the security or operation of the Services;
- impersonate anyone or submit requests for someone else without permission;
- use the Services to send spam or to contact homeowners or contractors outside the purpose of a request.
Our content
The Services, including text, cost data, cost estimators, designs, logos and software, belong to GOLDGCP or its licensors and are protected by law. You may use them for your own personal, non-commercial purposes.
Copyright complaints
If you believe content on the Services infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent: Enjoy Digital LLC, Attn: Copyright Agent, 30 North Gould Street, Sheridan, WY 82801, info@goldgcp.com. Include your contact details, the work, where it appears on the Services, a good-faith statement and a statement under penalty of perjury that you are authorized to act.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, GOLDGCP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. GOLDGCP IS NOT RESPONSIBLE FOR THE WORK, PRODUCTS, ESTIMATES, CONDUCT OR LICENSING OF ANY CONTRACTOR. Some states do not allow certain disclaimers, so some of these may not apply to you.
Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, GOLDGCP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM THE SERVICES OR ANY CONTRACTOR'S WORK. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID GOLDGCP IN THE 12 MONTHS BEFORE THE CLAIM OR US$100. These limits do not apply where the law does not allow them.
Indemnity
If you break these Terms or the law, or misuse the Services, you agree to cover GOLDGCP's reasonable losses and costs, including legal fees, from claims brought by others because of it, to the extent the law allows.
Disputes
- Talk to us first. Most concerns can be solved quickly. Email info@goldgcp.com with a description of the problem, and we will try to resolve it informally within 30 days.
- Arbitration. If we cannot resolve it, you and GOLDGCP agree that any dispute about the Services will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except that either of us may bring an individual claim in small-claims court. The Federal Arbitration Act governs this section. Claims may be brought only individually, not as a class or representative action, unless the law does not allow this waiver for a particular claim; nothing here prevents you from seeking public injunctive relief where the law gives you that right.
- Your right to opt out. You can opt out of arbitration by emailing info@goldgcp.com within 30 days after you first agree to these Terms, with your name and the words "arbitration opt-out".
- Governing law. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, and by the Federal Arbitration Act. This does not take away any protection given to you by the consumer laws of the state where you live.
Other terms
- Electronic communications. You agree that we may provide notices and agreements electronically.
- Changes. We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you by email or on the Services before they take effect. Changes do not apply to disputes already pending.
- Ending use. You may stop using the Services at any time. We may suspend or end access if you break these Terms or to protect users or the Services.
- Age. You must be at least 18 to use the Services.
- Entire agreement. These Terms, together with the documents they link to, are the whole agreement about the Services. If any part is unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver.
